NYS Workers’ Compensation Board Emergency Decision
On March 27th, 2020 the New York State Workers’ Compensation Board made an emergency decision regarding COVID-19. Effective immediately, and to last at least 90 days, an employee can submit a claim for Paid Family Leave to care for a family member diagnosed with the COVID-19 virus. Any employer currently required to provide Paid Family Leave under NYS law will be mandated to adhere to this decision. This emergency decision was made to avoid confusion and litigation with insurance carriers during this unprecedented time.
